NEWS: US Patent Infringement Lawsuit Viscotaq
After receiving Stopaq's May 2010 warning letter notifying Amcorr Product and Services, Inc. that its Viscotaq product line infringed Stopaq's US patent, Amcorr, sister company Dolphin Sealants LLC, and apparent majority shareholder Kleiss & Co BV together brought an action in August 2010 against Stopaq before the Dutch courts in The Hague, Netherlands, seeking a declaration that Amcorr's Viscotaq product line does not infringe Stopaq’s US patent.
Stopaq responded to this action by immediately filing a patent infringement lawsuit against Amcorr and Dolphin Sealants in US federal court in Houston, Texas, and requested that the US court enjoin Amcorr from pursuing its Dutch action.
After a court hearing regarding Stopaq's injunction request, the parties agreed to suspend the case before the Dutch courts pending the outcome of the US patent lawsuit, which has since proceeded in Houston.
Stopaq subsequently requested that the federal court in Houston grant Stopaq's motion for summary judgment that Amcorr and Dolphin Sealants infringe Stopaq's US patent.
Following a hearing, the summary judgment motion is pending before the court.
